Why guardianship is an overlooked lead source

Most real estate investors focus on foreclosure and probate. Guardianship filings are a less-known but high-quality lead source. When a court appoints a guardian over an incapacitated person's estate, the guardian frequently needs to sell real property to pay for the ward's care. The property is often unmaintained and the guardian is motivated to sell quickly.

Because guardianship isn't a well-known investor lead type, competition is materially lower than foreclosure or probate. The same filing-day speed advantage applies: reaching the guardian early, before the property is listed or other investors find it through less-direct channels, gives you a better chance at a fair deal.

Guardianship vs probate

Probate handles the estate of a deceased person. Guardianship handles the property of a living person who can no longer manage their own affairs. Both create motivated-seller situations, but guardianship has lower competition and often involves properties that have been neglected due to the owner's incapacity. The guardian has a fiduciary duty to act in the ward's best interest, which often means selling property to fund care rather than letting it sit vacant.
