Foreclosure Laws by State
Tap a state to see whether its foreclosures go through the courts, the earliest date a foreclosure sale can legally happen, how long an owner has to redeem after a property tax sale, and how long creditors have to claim against an estate in probate. Every fact is quoted from an official state source (the statute, a court rule, or the act that wrote the statute text), with a link to it and a tag saying which kind it is.

The same facts as the map, one state per row. Open a state to read its foreclosure type, waiting periods, redemption rights, tax sale redemption period, probate creditor window and how its divorce law treats a marital home, each with its source. Timeline article and calculators
General information about each state's law, checked October 2026. A fact is shown only when its source is an official state site (the legislature or the courts), its quoted words are on that page, and the period stated is in those words. Waiting periods are legal minimums; real cases often take longer, and some periods can be shortened (for example for abandoned property) or extended by a court. The law can change. Not legal advice; talk to an attorney licensed in the state where the property is.
Judicial vs. non-judicial foreclosure
In a judicial state, the lender files a lawsuit and a judge must approve the foreclosure before the property can be sold, which adds court steps such as service, a chance to answer and a judgment. In a non-judicial state, a mortgage or deed of trust with a power of sale lets a trustee sell the property after the notices and waiting periods the statute requires, without a court case. Some states allow both, depending on the loan documents.
Want the dates worked out? The foreclosure timeline calculator counts the earliest legal sale date from each state's own starting event where the law fixes a minimum, and the free tools page lists every calculator.
