Pre-foreclosure in Travis County, Texas: what investors should know

Texas forecloses outside of court, the county is mostly renters, and equity runs thinner than the national average. Here is what that means when you meet a distressed owner in Austin's home county.

What Travis County housing looks like

Travis County has 594,638 housing units and a population of 1,307,625, with Austin as the county seat. The median home value is $488K. That is a high entry price, and it shapes every foreclosure deal here.

Fewer owners, fewer free-and-clear homes. Just 53% of homes are owner-occupied, and 33% of those owners have no mortgage, compared with 39% nationally. More owners carry a loan, which means a distressed sale often has a lender to satisfy before any equity reaches the owner.

Newer, denser stock. Only 2% of homes were built before 1940 (U.S.: 12%), and 52% are single-family detached (U.S.: 61%). You will see fewer century-old repair nightmares and more condos, townhomes and apartments in the mix. Vacancy is 6% against 10% nationally, so the market is tight.

Rents support holding. HUD Fair Market Rent in the Austin-Round Rock-San Marcos area is $1,817 a month for a 2-bedroom and $2,292 for a 3-bedroom. Permits for 15,059 new units were issued in 2025, down 11% from 2024, which is worth weighing if you plan to rent. Sources: Census ACS, HUD, Census Building Permits.

Which court filings come before a sale in Travis County

Pre-foreclosure in Travis County, Texas, is the best known distress signal, but it is not the only one. Three situations commonly lead to a sale, and each has its own people and pace.

  • Pre-foreclosure: the lender has begun the process after missed payments. The owner is usually under time pressure and may be open to a quick, fair sale.
  • Probate: an owner has died and the estate must settle. Travis County has Probate Court No. 1 in Austin. The heirs may want to sell rather than manage a property.
  • Divorce: the Travis County civil District Courts have original jurisdiction in all divorce cases and sit at the Civil and Family Courts facility in Austin. A shared home often has to be sold or bought out.

Only 11% of residents are 65 or older (U.S.: 17%), and the median age is 35.5 (U.S.: 38.9). Probate is therefore likely a smaller share of your opportunities here than in an older county, while divorce and mortgage stress among younger owners deserve more of your attention.

How foreclosure works in Texas, in plain terms

Texas is generally a non-judicial foreclosure state for loans secured by a deed of trust with a power of sale. The lender usually does not sue first. Instead it must follow the steps in Chapter 51 of the Texas Property Code.

The notice steps. The lender sends a notice of default and must give the borrower at least 20 days to cure. If the default is not cured, a notice of sale must be given at least 21 days before the sale. Sales are held on the first Tuesday of the month, within the hours and at the place the statute and the county designate.

Why the timing is tight. Because there is no court calendar to slow things down, an owner can move from a missed payment to a sale date quickly. Texas generally gives no right to redeem after a deed-of-trust sale, so the owner's real chance to act is before the sale. Details vary by loan documents and circumstances, so confirm any deadline with a Texas attorney.

Taxes work on their own calendar. Property is appraised at market value as of January 1, tax bills may begin mailing October 1, taxes are due by January 31, and they become delinquent on February 1. The deadline to protest with the appraisal district is May 15. Unpaid taxes can lead to a separate tax foreclosure, which follows different rules than a mortgage foreclosure.

Probate runs through the county's probate court, and divorce runs through the District Courts. In both, a judge's order or a settlement usually decides when a home can be sold.

How to approach owners respectfully and legally

People facing foreclosure, a death in the family or a divorce are often scared, grieving or embarrassed. Lead with honesty about who you are and what you can and cannot offer. Never imply you work for the lender or the court.

Keep contact low pressure. A short, plain letter that says you buy houses and would be glad to talk if they want to is often better than repeated calls. Let the owner set the pace. If they say no, stop.

Follow the phone rules. If you call, scrub against the National Do Not Call Registry and follow Texas telemarketing rules, including any state registration and calling-hour requirements. When in doubt, ask an attorney. The FTC publishes the federal rules.

Know the foreclosure-rescue traps. Texas has specific protections for homeowners in foreclosure, and deals that strip equity from distressed owners can draw legal trouble. Put everything in writing, suggest the owner talk to an attorney or a HUD-approved housing counselor, and never pressure anyone to sign quickly.

In probate, speak to the executor or the family, not around them, and wait until the right person has legal authority to sell. In divorce, remember that two people may need to agree, and each may have a lawyer.

What to look for before making an offer

A Travis County price tag leaves little room for error, so slow down on the numbers.

  1. Total debt against value. With 33% of owner-occupied homes free and clear, many owners have a loan. Compare the payoff, any second liens and unpaid taxes with what the home would realistically sell for.
  2. Property type. With 52% of homes single-family detached, plenty of distressed properties are condos or townhomes. Association dues and rules can change both the exit and the holding costs.
  3. Condition. Housing here skews newer, but newer is not the same as sound. Inspect when you can, and budget for surprises where you cannot.
  4. Exit plan. If you will rent, compare your all-in cost with the HUD figures of $1,817 for a 2-bedroom and $2,292 for a 3-bedroom. If you will resell, remember that permits fell 11% from 2024 to 2025, which signals a changing supply picture.
  5. Title and authority. Make sure the person signing has the right to sell. In a probate or divorce, that may require a court order. Use a title company and an attorney.

Bidding at a foreclosure sale is a different game from buying from a motivated owner. Properties at sale are generally bought as is, so know what you are taking on. See also our guide to pre-foreclosure leads and the Texas overview.

Questions investors ask

Is foreclosure in Travis County handled by a judge?

Usually not. Texas mortgages typically carry a power of sale, so lenders foreclose without going to court if they follow the Property Code notice steps. A court can still become involved if the owner sues or files bankruptcy.

How much time does an owner have to catch up?

The law requires a notice of default with at least 20 days to cure, then notice of sale at least 21 days before the sale. Loan terms and circumstances vary, so owners and investors should confirm real deadlines with a Texas attorney.

Can an executor sell a house in Travis County?

Sometimes, but it depends on the will and on what authority the probate court has granted. The executor generally needs that authority in place before signing. Ask the estate's attorney before making an offer.

Do I have to follow Do Not Call rules when contacting owners?

Yes. If you phone owners, you need to follow the federal Do Not Call rules and Texas telemarketing requirements. Written, respectful outreach is often a safer first step.
